What Are South Carolina Foreclosure Laws?
First, it's important to note that South Carolina is a judicial foreclosure
jurisdiction. State law mandates that a creditor must take a borrow to
court to prove it is within their right to foreclose on a property. However,
because South Carolina is a judicial foreclosure state, the borrower is
able to file a counterclaim.
In some states, borrows are given a right to redemption, which gives them
the ability to buy back a property that has been foreclosed on, even if
the foreclosure has been completed. This right to redemption only lasts
for a predetermined period of time. However, South Carolina does not permit
borrows the right to redemption. As soon as a foreclosure sale is complete,
the borrow has no rights to the property. This is often referred to as
the "Hammer Rule."
Additionally, South Carolina gives mortgage lenders the right to seek deficiency
judgements. These can occur when the price of the foreclosure is not enough
to meet the full amount that the borrower still owes the lender. Therefore,
the lender is permitted to hold the borrower liable to pay the difference.
At the same time, borrowers have appraisal rights if a creditor deems
the foreclosure sale price deficient. They can ask that the fair market
value of the property is calculated when determining deficiency.

CLIENT REPORTING
The client is provided with information on the progress of its cases throughout
the process and is sent copies of all pleadings and any pertinent correspondence
and cross-claims or counterclaims brought by any defendant. The client
is also provided with monthly reports. The type and frequency of these
reports are adapted to the client's needs. These reports may consist
of individual case summaries and aged spreadsheet reports.
COMMERCIAL OR COMPLEX MATTERS
Occasionally, foreclosure matters will become involved, contested, or complex.
The foreclosure division coordinates with the Firm's litigation division
in the event that the matter becomes contested. At this juncture, we discuss
the parameters of the issues thoroughly with the client, the steps that
we recommend be taken, and the approximate time and cost. The client can
then make an informed decision on how it wishes to proceed.
RESIDENTIAL FORECLOSURES
Time: Routine foreclosure matters are processed in approximately
120 to 180 days from the date that we receive the referral to conclusion.

including attorney fees & costs); (2) Paying off your account in full;
