Foreclosure

The foreclosure division's primary goal is to process a volume of commercial and residential foreclosure matters statewide as quickly and efficiently as possible, and to provide quality legal services in the shortest period of time at the least expense to the client.

CLIENT REPORTING

The client is provided with information on the progress of its cases throughout the process and is sent copies of all pleadings and any pertinent correspondence and cross-claims or counterclaims brought by any defendant. The client is also provided with monthly reports. The type and frequency of these reports are adapted to the client's needs. These reports may consist of individual case summaries and aged spreadsheet reports.

COMMERCIAL OR COMPLEX MATTERS

Occasionally, foreclosure matters will become involved, contested, or complex. The foreclosure division coordinates with the Firm's litigation division in the event that the matter becomes contested. At this juncture, we discuss the parameters of the issues thoroughly with the client, the steps that we recommend be taken, and the approximate time and cost. The client can then make an informed decision on how it wishes to proceed.

RESIDENTIAL FORECLOSURES

Time: Routine foreclosure matters are processed in approximately 120 to 180 days from the date that we receive the referral to conclusion.

If your Loan has been referred to our law office to begin a foreclosure proceeding, you may contact our office if you'd like information regarding: (1) Reinstating your account in full (completely catching up the delinquency including attorney fees & costs); (2) Paying off your account in full; or (3) Other loss mitigation options that may be available through your mortgage company. However, our firm cannot provide to you any legal advice. If you need legal advice you must consult your own attorney.

When contacting our office, include a detailed message including your name, loan number, property address, what type of information you want (whether you want reinstatement figures, payoff figures, or information on loss mitigation options that may be available through your mortgage company), and to which address you want the information sent to you. If you email, fax or mail your request you will also need to complete a mortgagor form.

Please be prepared to give your name, loan number, property address, what type of information you want (whether you want reinstatement figures, payoff figures, or information on loss mitigation options that may be available through your mortgage company), and to which address you want the information mailed.(4) By hand delivery or U.S. Mail: For reinstatement and/or payoff figures only - Please fill out and sign the attached Form A and return it to us in person or send it to the address listed on Form A: Finkel Law Firm LLC, ATTN: Foreclosure Loss Mitigation, P. PLEASE NOTE: In any case, please allow 5-7 business days for your request to be processed. If you do not receive a response from our office within 5 to 7 business days, please call and ask for our Foreclosure Loss Mitigation Specialist at (843) 576-4325. Reinstatement and/or payoff figures can only be sent to you by U.S. Mail unless you request in writing on the attached form that they be faxed/e-mailed to you.
