Firm Overview

Founded in 1970, the Finkel Law Firm (the “Finkel Firm”) has been serving people and businesses of South Carolina for over thirty-five years. 

IN THE BEGINNING

By representing the Plaintiffs in the case of Mims v. Yarborough, 343 F.Supp. 1146 (D.C.S.C. 1971), the Finkel Firm made a conscious commitment to provide sophisticated legal services in complex legal matters.  The Mims case was a landmark decision involving a suit for an injunction against public officials charged with carrying out a proposed water project.  In a companion case, the Finkel Firm also was the first law firm in South Carolina to successfully use federal antitrust law.  See Mims v. Kemp, 516 F.2d 21 (4th Cir. 1975).  These cases set the stage for the Finkel Firm’s reputation for representing individuals and businesses in complex legal matters and led to the Finkel Firm’s continued development as a leader among South Carolina’s legal firms.  Over the years, the Firm has continued to be a major player involved in a number of major cases of novel impression, and continued to develop its reputation for handling complex cases. 

THE 1980'S

In the 1980's, the Finkel Firm represented the major creditor, Marathon Oil Company, in its $60,000,000 claim in the Hilton Head Bankruptcy.  The Finkel Firm also represented Brittons and Sam Solomon Company in their Chapter 11 proceedings and represented the Unsecured Creditors Committee in the Braswell Shipyards, Inc. bankruptcy. 

THE 1990'S

In Lucas v. South Carolina Coastal Counsel, 60 L.W. 4842 (1992), the Finkel Firm successfully challenged South Carolina’s Beach Front Management Act and required the state to pay for the impact of that statute on individual home owners and other property owners.  The Finkel Firm represented the developers of the tallest building in South Carolina in the bankruptcy case of Capital Center Associates, Inc. where the claims of the secured creditors alone exceeded $55,000,000 and represented the developers in several complex commercial work outs including Frontage Realty Limited Partnership, Park Area Development, Wes-Mar, Columbia Capital Holding Corporation, and Stoneridge Limited Partnership.

THE 2000'S

In the early part of the decade, the Finkel Firm grew its construction litigation practice and its foreclosure practice.  Between 1998 and the end of 2005, the Finkel Firm had resolved over $20,000,000 of construction litigation on behalf of homeowners.  In 2006, the Finkel Firm concluded two large suits involving beach front condominiums with those homeowners associations receiving in excess of $15,000,000.  In addition, the foreclosure department of the Finkel Firm grew to where it now handles millions of dollars worth of foreclosures each year.  Thus, the Finkel Firm’s reputation continues to grow in the State Courts of South Carolina.  In the Federal Courts, the Finkel Firm represented the Plan Trustee in the HomeGold, Inc., HomeGold Financial, Inc., and Carolina Investors, Inc. bankruptcies and directed federal litigation against the former officers, directors, professionals and insurance carriers.  The Finkel Firm continues practice at the cutting edge of South Carolina and National Law. 

THE FUTURE

The Finkel Firm has developed into a full service law firm, handling all types of litigation, residential and commercial real estate, corporate, finance, bankruptcy, foreclosure and taxation matters.  With offices in Columbia and Charleston, we have the opportunity to service all of our South Carolina clients more effectively. 

The Finkel Firm possesses a unique blend of both experienced lawyers and younger lawyers trained in the latest discovery and trial techniques.  All of the members of the Firm are dedicated to the practice of law in South Carolina.  Several attorneys teach at the Charleston School of Law and have taught at the National Judicial College.  In addition, the lawyers are active in continuing legal education and participate in the committees of the American Law Institute, the American Judicature Society, the American Bar Association, the American Bankruptcy Institute, The South Carolina Association for Justice, the South Carolina Bar Association, the Richland County Bar Association and the South Carolina Bankruptcy Law Association.  By remaining active in teaching and participating in the development of the law, the Finkel Firm remains on the cutting edge of legal thought and emerging trends in the law to best serve our client’s interests.
